I think a takedown is more akin to a cease and desist notice, it’s a warning prior to any legal action being taken (although cease and desist normally requires the person who is using something unfairly to take down the content on their own), anything like this involving DMCA is a forced takedown so I’m not sure how that applies but I haven’t heard anything about a lawsuit.
